These Terms of Service (“Terms”) govern your access to and use of the FuseDesk website, application, and related services (collectively, the “Services”) provided by FuseDesk, operated by FuseDesk LLC (“FuseDesk,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility & Accounts
You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account.
2. Use of the Services
FuseDesk provides CRM and project-management tools for freelancers and agencies, including projects, clients, proposals, invoices, time tracking, scheduling, expenses, and reporting. You agree to use the Services only for lawful purposes and in compliance with these Terms. You will not misuse, interfere with, reverse engineer, or attempt to gain unauthorized access to the Services.
3. Your Content
You retain ownership of the content and data you submit to FuseDesk. You grant us a limited license to host, process, and display that content solely to provide and improve the Services. You are responsible for ensuring you have the rights and any necessary consents to submit content—including the contact details and consent of any clients or third parties you add to your account.
4. SMS / Text Messaging Program Terms
These Messaging Terms describe FuseDesk’s text messaging program and supplement these Terms. By providing your mobile phone number and opting in, you agree to these Messaging Terms.
Program description
FuseDesk sends transactional, account-related text messages to users who opt in. We do not send marketing or promotional text messages through this program. Message types include:

Consent & opt-in
You opt in to receive text messages by providing your mobile number and affirmatively agreeing during sign-up or in your account settings. Consent to receive text messages is not a condition of purchase of any goods or services. We only send messages to numbers that have opted in.
Message frequency
Message frequency varies and depends on your account activity (for example, how many appointments, invoices, or login events occur).
Cost
Message and data rates may apply. Such charges are billed by and payable to your mobile service provider. FuseDesk does not charge for the text messages themselves.
Opt-out
You can cancel the SMS service at any time by replying STOP to any message. After you send STOP, we will send a one-time confirmation that you have been unsubscribed, and you will no longer receive SMS messages from us. To rejoin, opt in again from your account settings.
Help
For help, reply HELP to any message or contact us at support@fusedesk.app. Carriers (including, for example, AT&T, T-Mobile, and Verizon) are not liable for delayed or undelivered messages.
Privacy
Your mobile information and opt-in consent are handled as described in our Privacy Policy. No mobile information or opt-in consent will be shared with third parties for marketing or promotional purposes.
5. Fees & Billing
Certain features of the Services may require payment. Where applicable, you agree to pay all fees and applicable taxes for your selected plan. Fees are non-refundable except as required by law or expressly stated. During the pre-launch period, the Services may be offered free of charge and subject to change.
6. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Services or other users. Upon termination, your right to use the Services ends, though certain provisions survive as described below.
7. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
8. Limitation of Liability
To the maximum extent permitted by law, FuseDesk and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless FuseDesk and its operators from any claims, damages, or expenses arising out of your use of the Services, your content, or your violation of these Terms or applicable law.
10. Governing Law
These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Tennessee for any dispute arising out of or relating to these Terms or the Services.
11. Changes to These Terms
We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
